WPUSD Faces State-Level Review Amid Records Dispute and Allegations of Procedural Violations

LINCOLN — An investigation by Dismal Freedom Press into the Western Placer Unified School District has escalated to the California Department of Education following what the newsroom describes as a pattern of missed statutory deadlines, disputed records claims, and the omission of a key coordination email from the district's official administrative record.

Origins of the Investigation
The inquiry stems from a December 2025 meeting of a student club called Club America at Twelve Bridges High School, during which Lincoln Mayor Holly Andreatta delivered a speech. DFP filed a formal Uniform Complaint alleging the event created a hostile educational environment through what it characterizes as "stigmatizing and discriminatory framing related to sexual orientation."
The district dismissed those allegations, arguing that student attendance at the event was voluntary. DFP's appeal disputes that framing, citing California law that does not require mandatory attendance for a hostile environment finding, and asserting that the district failed to adequately oversee an external speaker.
The Superintendent's Response
Internal district correspondence obtained by DFP through a Public Records Act request shows that Superintendent Kerry Callahan forwarded the original civil rights complaint accompanied by a laughing face emoji. DFP has cited this correspondence as evidence bearing on whether the district conducted a good-faith local investigation. The district has not publicly addressed the communication.
Board Vote and Exhaustion of Local Remedies
On January 20, 2026, the WPUSD Board of Trustees voted 4-0 to decline to hear the appeal. Under California's Uniform Complaint Procedures, that vote exhausted available local remedies and opened the path for a state-level appeal to the CDE.
The Records Dispute
A parallel California Public Records Act dispute has complicated the investigation. DFP submitted a records request on January 22, 2026, seeking metadata related to December 17 district communications. Assistant Superintendent Michael Maul subsequently stated that the district has "no record" of receiving that request.
DFP has produced documentation it characterizes as forensic proof of delivery, including a unique Message-ID — CA+A8pG_o_X2Yp8v+3y1+Gz9=H8=y9XG@mail.gmail.com — and records indicating that both Maul and Superintendent Callahan were copied on the transmission at 11:14 AM PST on January 22, 2026.
The district missed a February 17, 2026, 5:00 PM deadline to either produce the requested records or provide a written justification for any withholding. DFP subsequently issued a formal Notice of Statutory Violation.
The Omitted Email
A separate records request submitted January 30, 2026, yielded an email from Board Vice President Marjorie Proffitt that DFP says shows her coordinating the Club America event. That email was not included in the district's initial administrative record produced during the complaint phase. DFP has raised this omission with the CDE as a material gap in the administrative record. The district has not responded to that characterization.
In a separate matter, WPUSD failed to post the minutes of its January 20 board meeting by its own stated February 10 deadline, further delaying the public record of the vote to decline the appeal.
State Filing
As of February 18, 2026, DFP is filing an Urgent Consolidated Supplemental Filing with the CDE Appeals Office. The filing asks the state to vacate a prior determination that the appeal was premature, arguing that the local investigation process has been compromised by bias, an incomplete administrative record, and procedural delay in records production.
District Response
DFP requested comment from WPUSD, Superintendent Callahan, Assistant Superintendent Maul, and Board Vice President Proffitt prior to publication. This article will be updated to reflect any response received.
